SHRI KRISHNA JANMABHOOMI CASE :- WHY IT IS HAPPENING MYSTERIOUS CASE

 



The Allahabad High Court on December 14 allowed an application seeking appointment of a court commission to inspect the Shahi Idgah mosque, which sits next to the Krishna Janambhoomi temple in Mathura.


The inspection will be done by a court-monitored three-member team of advocate commissioners, and the modalities and composition of the commission will be decided on December 18.

The order comes at a time when the Archaeological Survey of India (ASI) is already conducting a scientific survey of the Gyanvapi mosque in Varanasi, after petitioners claimed that it was a Hindu temple.


The order of inspection of the Shahi Idgah was pronounced by Justice Mayank Kumar Jain. The plea was filed on behalf of Hindu deity, Bhagwan Shri Krishna Virajman and seven others, who in their original suit pending before this court, have claimed that the mosque was built over Krishna Janmabhoomi (birthplace) land, on the orders of Mughal emperor Aurangzeb in 1670.

My demand was that Shahi Idgah Masjid bears many signs and symbols of the Hindu temple. To ascertain the actual position, an advocate commissioner is required. It's a landmark judgment by the court," Jain emphasised.


Justice Mayank Kumar Jain had reserved the order on the application on November 16.




The Hindu side claims that the Idgah mosque was constructed by Mughal Emperor Aurangzeb by demolishing a temple on 13.37 acres of Lord Krishna's birthplace. This original suit is pending before the High Court.


As many as 17 suits are pending in the High Court, with the main pleas seeking a declaration that the land under dispute --where the Shahi Eidgah Mosque is situated--vests in the deity Lord Shri Krishna Virajman. Additionally, they seek a direction for the defendant to remove the mosque.

The Supreme Court on Friday refused to stay an Allahabad High Court order which allowed a primary survey of the Shahi Idgah mosque complex adjacent to the Shri Krishna Janmabhoomi Temple in Uttar Pradesh's Mathura.


The Allahabad High Court, on Friday (December 15), allowed the primary survey of the Idgah complex by a court-monitored three-member team of advocate commissioners.


"The Supreme Court has refused to stay the proceedings and has fixed the matter so far as challenge to the transfer order is concerned on 9th of January...The High Court order will continue and the High Court will proceed with the matter and there is no stay by the Supreme Court,” Vishnu Shankar Jain, the lawyer for the Hindu side said.
